Account Holder Terms and Conditions

Pronet Innovation Ltd, trading as eventplus is an event registration platform.


eventplus provides Event Organisations with a platform where they can sell products and services such as but not limited to; Event registrations, products, services, memberships and donations.

These Terms and Conditions, and any other terms and policies referred to in these Terms and Conditions, form the agreement between Pronet Innovations Limited, trading as eventplus (referred to as “eventplus”, “we” or “us”) and the user (referred to as “Account Holder” or “you”), collectively referred to as the Parties or each a Party, (Agreement). 

This Agreement sets out the terms upon which eventplus has agreed to grant permission to the Account Holder to use the eventplus platform. This Agreement is binding on any use of the platform and applies to the Account Holder from the time that eventplus provides the Account Holder with an account to access and use the platform services.

Minors (under 18 years of age)

You must not create an eventplus Account unless you are at least 18 years of age.

Minors needing to use eventplus platform services, must be entered by a parent, legal guardian, or instructor such as a teacher or coach (with approval from parent or legal guardian) who is over 18 years of age, using their eventplus Account.  A Sub Account can be created for the minor. 

Agreement

By using our platform, you acknowledge that you have read, understood, and accepted this Agreement and our Privacy Policy.

You have the authority to act on behalf of any person or entity for whom you are using the platform, and you are deemed to have agreed to this Agreement on behalf of any entity for whom you use the platform. 

eventplus Account

In order for you to use the eventplus platform either as an Event Organiser (Client) or to purchase from an Event Organisation (Customer), you will create an eventplus account.  eventplus will provide this information to the Event Organisation by which you have purchased, or commenced the purchasing process with.

As an eventplus Account Holder you may use the eventplus platform for the purposes intended by the platform 

1. Using Event Organiser administration facilities (organiser only);
Or
2. Entering events;
3. Purchasing store items;
4. Updating details;

As an eventplus Account holder you are responsible for:

1. Keeping your login details safe;
2. Providing accurate personal details for both yourself and any other persons whom you create Sub Accounts for;
3. Only use the account for the intended purposes.

As an eventplus Account holder your information may be:

1. Published in a public starters list;
2. Published in a public results lists (virtual or actual events);
3. Disclosed to 3rd party suppliers for the supply of event products or services (merchandise);
4. Published or disclosed to other parties at the discretion of the Event Organisation.

eventplus reserves the right to disable or delete your account. 

Purchasing from an Event Organisation

As part of the purchasing process with the Event Organisation you will be presented with the Event Terms and Conditions / waiver which are set out by the Event Organisation.  You will need to accept these commercials before you can proceed to complete your purchase or submission.  These terms are between you and the Event Organisation.

The eventplus Account Holder can purchase (usually by way of event registration) for themselves, or on behalf of other people by creating Sub Accounts.  The Account Holder is responsible for communicating with any other person they purchase on behalf of by way of a Sub Account. 

The payment methods offered are set by the Event Organisation. There may be an additional booking / processing fee which is also determined by the Event Organisation.

An order email will be sent to the Account Holder upon completion of payment.  This will indicate if there is sales tax included in the purchase.

Disclaimer

eventplus are not responsible for any aspect related to the Event, supply or delivery of any of the purchases.  The Event Organisation is responsible for supplying the Event, products and services. Also any changes including but not limited to refunds or transfers and the likes.

Any grievances in relation to your purchases or submissions are to be raised with the Event Organisation.  

eventplus is not responsible for any Event Organisation disclosure of your data to other parties. 

eventplus does not make any warranties that the eventplus platform will be free of errors or availability, and is in no way liable for any failure or delay of the service. 

eventplus will not be liable or responsible for service failure or delay.   eventplus will not be liable for any claims, including, but not limited to, injury, consequential damages, loss of revenue, additional expenses in connection with the use of the eventplus platform, whether as a result of any breach or default by eventplus.  

The maximum liability of eventplus under this Agreement for any and all breaches of this Agreement, and any negligence in relation to this Agreement, will not exceed the total Payments made by you via the eventplus platform.

This Agreement is governed by the New Zealand law. You agree that you submit to the exclusive jurisdiction of the New Zealand courts in respect of any dispute arising under this Agreement. 

Terms relevant to this agreement

1. Account Holder (user) is someone who has an eventplus Account 
2. eventplus Account is a set of credentials used to authenticate an Account Holder. The Account consists of personal details such as; but not limited to, name, date of birth, contact details and password.
3. Client, also known as Event Owner is an Account Holder who has been given Client Privileges in order to sell products and services.
4. Client Privileges Additional privileges granted to allow Clients to sell products and services
5. Customer An Account Holder who seeks to purchase from a client using the eventplus platform.  A Customer is most commonly an Event Entrant. 
6. Event Organisation is an organisation by which the Event Owner (Client) is associated with. 
7. Event Owner (also known as Client) is an Account Holder who has been given Client Privileges in order to sell products and services.
8. Sub Account is a person established under the Account Holders account, by the main Account Holder.  The Account Holder can purchase on behalf of that person and takes all responsibility for any activity, or respective outcomes in relation to those Sub Accounts

Privacy Policy and Terms of Use

eventplus has created this privacy policy because we want you to know exactly what information we gather, why we gather it and how it is used.
Whenever you start the signup process for an event or if our privacy policy has changed we will show it to you again. (Sorry if it is annoying, but we're serious about our responsibility to keep you informed!)

What kind of personal data do we process and why?

Account Information
eventplus provides event registration services to event organisers. Our business model does not include making money from advertising or selling information, we will never sell your personal data to anyone, ever.

As part of event registration we collect and store some basic personal details about you, such as your name, email, date of birth and contact details. This is your 'eventplus Account' which can be used to quickly enter any event for which we provide services. The information in your eventplus account is retained as long as your profile is active so that it is available for any future event entries you may make. You can view, update and correct this information at any time.

The information in your profile is only made available to event organisers when you choose to sign up for one of their events or purchase a product from them. We never share your contact details with any event organiser unless you choose to interact with them.

Event Specific Information

When you sign up for an event, Event organisers often choose to gather additional information specific to their events, such as athletic experience or emergency contact details. This event specific information is stored by eventplus as part of your event registration but is not available to other event organisers and is not part of your 'eventplus account'.

Usage Data

We record your IP Address and browser user agent details when you access eventplus services. We use this information both to defend against security threats and also to generate statistics on what operating systems and web browsers are being used, demographics of visitors and other analytics which we use to help improve our services. Access logs are are purged periodically. Your last used IP address and browser user agent are stored against your eventplus account.

Cookies

Cookies are small data files transferred onto visiting computers or devices by websites to help remember who you are during your visit to the site. We only use cookies to keep your session secure, we do not use them to track you and they contain no individually identifying information. Cookies are stored on your individual device and you have full control over their use. You may deactivate the use of cookies by changing the settings of your web browser. Cookies that are already stored may be deleted at any time. You will not be able to use eventplus services with cookies deactivated.

Contact with us via Support

You may choose to contact support by online chat or email. Any information you provide to support will only be used solely in connection with answering your support queries.

Access and Disclosure to Third Parties Like many businesses our services are built on other services provided by trusted third party companies, therefore your data may be stored by or transmitted via these companies. Third party service providers are not permitted to use your data for any purpose other than the provision of services to us.

All credit card payments are handled by accredited third party service providers, no credit card processing is carried out within the eventplus service.

We may be compelled to disclose personal information when required by law or court order or legal process served on us.

As we provide a service to event organiser we cannot exert control over their use of your data once it leaves our systems. If you have concerns about this then we recommend you contact the event organiser directly before proceeding.

Communications

Organisers of events for which you have signed up may use your email address to send you news and event promotion information about their events. Where the emailing service is provided by eventplus there will always be the option to unsubscribe.

External Links

While using eventplus you may be presented with links to external websites, such as an event websites, product manufacturers or social media sites. eventplus is not responsible for the content and privacy practices of other websites.

Your Rights

You have the right to be informed of personal data collected and processed by eventplus, the right to have that data corrected if it is incorrect and the right to have your personal data erased.

You also have the right to receive a copy of all the personal information you provided us with in a common computer file format.

We can only identify you via your email address and we can only adhere to your request and provide information if we have Personal Data about you through you having made contact with us directly and/or you using eventplus services. We cannot provide, rectify or delete any data that we store on behalf of our users or customers.

To exercise any of the rights mentioned in this Privacy Policy and/or in the event of questions or comments relating to the use of Personal Data you may contact the eventplus support team: dpo@eventplus.net

Where you have provided consent, you may withdraw it at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of eventplus Services. You further agree that eventplus shall not be held liable with respect to any loss and/or damage to your Personal Data if you choose to withdraw consent.

Where Personal Data is processed for the above purposes on the basis of eventplus's legitimate interests, under the GDPR, you may object to such processing at any time. To do so please contact : dpo@eventplus.net

In addition, you have the right to lodge a complaint with the data protection authority in your jurisdiction.

Duration of Processing

We will store your personal data until such time when you withdraw your consent for us to do so. All other data as specified above will be retained for as long as is necessary for the purposes for which we originally collected it. We may also retain information to meet our legal obligations.

Revisions to this Privacy Policy

We may revise this Privacy Policy from time to time. The most current version of this Privacy Policy will govern our practices for collecting, processing, and disclosing personal data. We will provide notice of any modifications posting a written notice on our site and by showing the updated policy the next time you login to eventplus.

Disclaimer

Your use, or access, of eventplus services constitutes your agreement to be bound by these provisions.
